How to become a notary public in NY?

How to become a notary public in NY?

If you wonder how to become a notary public in New York, Welcome to my blog and I will guide you how to become a notary public step by step as a notary. First of all, You need to face that This job may won’t give you higher revenue If you work as an individual self employment. IT is hard to raise the revenue for just doing regular notary. However, If you would like to work in the court or make extra money as real estate agent and banker, health care worker. Otherwise, It is all depend on how you work and how you advertise yourself as a notary and the loan signing agent for side job. most of people asked me when i just became a notary that you would offer it for free and I said no. Most of people known that the notary service is free at the bank and court. yes it is free but the bank and the court pay for their employees who work as notary and their employee. Therefore, I would like to recommend that you may need to consider to become a notary if you want to taking this job only for money.

Here is the way I became a notary

  1. take a practice test as much as you can

as all know, this job require a license by the new york state. Therefore, You need to pass the notary license test. I studied for almost 3 months just for memorizing and taking the practice test during the end of the pandemic. when i took this test, the dOS released the test again after the pandemic at the center and now  you can register anytime every month through the DOS official website. it is important to check the test schedule and Find the right time for taking this test. i can’t exactly say the level of this test. However, If you are good at memorizing. I would like to recommend this test as well.

    2. drop the application after you receive the test result

After you pass the test, YOu must apply the license with your result slip. they will send the slip within 2 weeks and let you know whether you pass the test or failed and go to the new york business express website. fill out the application online and pay the fee for the licensing. it is $60 and they will email or mail you the license.

   3. Order the notary supplies

Notary require to purchase several equipment for conducting the notarial act. First of all the notary journal and the stamp. In new york state, There is no specific regulation for using embosser or stamp as seal. However, it is require to leave the seal on the document with your signature and name, seal. I’m using the notary inked stamp which commonly use with most of notary. If you would like to use the embosser seal. it is perfectly ok. according to NNA, They recommend you to use the blue and black ink. it also has no specific requirement for using another color of ink to do signing on the legal paper. However, apparently all notary are using blue or black ink only for the notarial act. Also, I would like to recommend you to purchase the date stamp, receipt book.

   4. Let’s start it !

once you received the license and ready for all equipment that you will be able to write a journal and leave the seal for the signer. you are good to go. NNS recommend you to have the E&O bond. Yes, you might need if you don’t have any experience in this field. Notary works have more things than what you have learned from book. It needs more extra study and certificate for loan signing work. Therefore, I would like to register the free class by experienced notary or network or National notary association before you conduct the notary act.

I would like to share this information with someone who want to become a notary and for future of co-worker. This work may won’t be able to find the enough works just for yourself. it is require to work together with other field of people and sometime, you will need a witnessing the signature. There is correct answer and way to have many of tasks. but I would like to make comment some of things that I might can share in open book.

I will wish your luck for the test, If you are preparing this test and I will leave some free resource that I used to study around. I hope it will help you to become a notary.

is it ok to have dual signature on the document?

is it ok to have dual signature on the document?

You may wonder if you make a mistake to sign on the paper before you appear to notary. if you’ve signed on paper and don’t have time to print it out this again? It is ok to have the dual signature on the paper. Notary will ask you to sign it again on the specific place that the notary marks on for the another signature for verify. However, This is only for general legal documents. If you have legal paper and the loan signing documents. You must ask to notary if she/he can print it out again for signing or ready for extra paper by yourself. In NYS, There is no specific regulation for dual signing on the paper. but it is important to verify the signer’s signature. Follow your notary, If she/he ask you to sign again or print out new paper for the signing and must check the issuer or receiver of this document. In NYS regulation, There hasn’t specific rules for the dual signature. therefore, I would like to recommend you to follow the notary or make a call to the issuer and receiver.

The way you will be able to get a free notarization in NYC

The way you will be able to get a free notarization in NYC

In NYC, There is some way that you will be able to notarize your document for free.  Many of people already knew that the bank has the free notary service if the branch is available for the notary service and the banker who has the license for side hustle, they will help you to get a notarize for the customer. this is all paid notarization by the bank. on the other hands, The county clerk’s office offer a free notary service at the supreme court. They do free notarization for general document. however, They are not accepting any card payment. you should ready for cash over the hand. Otherwise, you will need to find the notary near you. UPS offer notary service depends on their store and they charge a fee.  I’m still using the court for free notarization cause as a notary, I cannot notarize my own documents by myself except for exceptional circumstance reasons. Free notarization service is good but sometimes need to wait in the long line up or bank notary is not always available and Not all UPS store is always offer the notary service. If you live near in battery park and financial district , I offer walk-in notarization for $2 and don’t need to waist your transportation fee to go to court. I don’t know if the customer think making appointment is inconvenience. you can call and text me. when you make an appointment unless you don’t need to wait in the line. overall, My office has clean and quiet waiting place with comfort seats and have complimentary for tea and coffee. feel free to have a time if you arrive too early in time. I hope you guys have helpful resource for the life from my post.

Here’s what to know If you feel your loan signing fee is too high

Have you done a loan signing and you feel the signing fee is too high? This is the honest answer if you would like to know. signing service just not a notary fee. This process need a lot of secretarial task and notary need a lot of supplies for this work. First of all the travel fee will be the most important things for the signing as the signing service usually not offer the on site services. It is not possible to offer that service. However, because of the privacy matter, signer are prefer to use the mobile service at their location. for the second reason, It will be the cost of supplies and expenses for this job. Notary are not the income based worker. Once the notary is not assigned to bank and court, other company where needs for paid notary. most of notary are working as self employed and co working with signing service company for freelancer. notary need a copy machine for legible document and printing, copying, scanning for the works and the cost may vary for their volume of signers. for the unexperienced signing agent, it can cost you a lot for setting the supplies to do this job. also at the community board , they are mentioning the fee for delivery of documents and traveling, supplies fee. and notary usually paid after 40days when they assigned to signing service company and I saw some signing agent couldn’t paid by their signers.

Can i notarize a document with no date?

Can i notarize a document with no date?

If you are a notary, it will help you to start the notarization for the first time. As a notary who have done the first notarize and furthermore, I had this experience that the document missed the date on the statement. I pulled up all my memory from the regulation that I acknowledged to be a notary and confirmed from NNA notary bulletin. IF the signer’s statement doesn’t have date on it, It is oK to notarize unless it is not the loan document and related with purchase of real estates and other legal document

If there is no date, you can still notarize the signature as you normally would, provided that all other requirements for notarization in your state are met. You can write down a note in the “additional information” section of your journal entry that the document did not have a date.

However, If someone ask  you to backdate, You might need to consider to get an advice. It is illegal to be backdate for mortgage and seller packages and certain legal documents.

you must check first if you are dealing with this situation. ask the signer to have a time for checking and then you will be able to look up and notarize it.

Can i get a notarize for out of states documents?

Can i get a notarize for out of states documents?

You may wonder If you will be able to get a notarize the document which it is from out of states. I’ve gotten a lot of questions regarding it. and My answer is Yes. However, there is some condition that Yon must check before you get notarize.

If you have a document that needs to be notarized in New York but was signed in out of states, you can still have it notarized in New York. Here are the general steps to follow:

  1. Find a Notary Public in New York: Look for a notary public in New York who is authorized to notarize documents. Notaries can typically be found at banks, law offices, or other businesses offering notary services.

  2. Bring the Document and Identification: Bring the document that needs to be notarized along with your valid identification (e.g., driver’s license, passport) to the notary in New York.

  3. Sign the Document in Front of the Notary: You will need to sign the document in the presence of the New York notary. The notary will verify your identity and witness your signature.

  4. Notary Applies Seal or Stamp: Once you have signed the document, the notary will apply their official seal or stamp and complete the notarial certificate.

  5. Receive the Notarized Document: After the notarization is complete, the document is considered legally notarized in New York.

It’s important to note that notaries in New York can notarize documents that originated from out-of-state as long as the signing and notarization take place within New York’s jurisdiction. Always confirm with the notary beforehand if they can assist with your specific document.

Unless your documents in your hands and signing in front of notary. IT is all OK do so.

If the document has already been signed in other states and you only have a printed or electronic copy in New York, you would not be able to notarize it in New York based solely on the other states signature. The signing would need to occur again in your presence in New York.

In my experience, You are serving the document from where issued out of state but you live in NY.

you can obtain a notarized affidavit of service that was originally issued in other states but served in New York, ensuring that it meets the necessary authentication requirements for use in NY legal proceedings.

First, Must check issuer of your document if it is require to signing with same state of notary and where the document use for proceeding.

New York notarized documents are generally accepted for use in other states across the U.S., but it’s important to be aware of any state-specific requirements or considerations that may apply based on the purpose and context of the document. Overall, the principle of reciprocity supports the widespread acceptance of notarized documents from one state to another.

Is it ok to notarize the document if signer’s name already printed(rather than handwritten) on the document?

Is it ok to notarize the document if signer’s name already printed(rather than handwritten) on the document?

Are you hesitating to notarize the document that printed signer’s name on the document?
Here’s the answer. In NY state, the signer’s signature likely more important than the printed signer’s name on the document. However, If it is misspelled, You must check from the ID card or request the other copy of document for notarization.

The ability to notarize a document when the signer’s name is already printed on the paper or misspelled compared to their ID card can depend on several factors and considerations, especially in New York City. Here are some key points to keep in mind:

  1. Verify Identity: As a notary public, your primary duty is to verify the identity of the signer. The signer must present a valid form of identification (e.g., driver’s license, passport, state-issued ID) that matches the person appearing before you.

  2. Name on Document vs. ID: If the signer’s name is already printed on the document, compare it with the name on their ID. Look for any discrepancies or misspellings.

  3. Address Discrepancies: If there is a discrepancy between the name on the document and the ID (e.g., misspelling), clarify this with the signer. Ask them to confirm their correct legal name as it appears on their ID.

  4. Confirm Identity: Ensure that the signer confirms they are indeed the person named on the document, regardless of any variations or misspellings.

  5. Legal Name: Generally, the signer should use their legal name as it appears on their identification document when signing legal documents. However, minor variations (like misspellings) might be acceptable if they can be clearly linked to the same individual.

  6. Notarization Decision: Based on your assessment of the identity verification process and the validity of the document, you can decide whether to proceed with notarization. If you have doubts about the identity or legality of the document, it may be best to decline notarization until the issues are resolved.

  7. Document Details: Keep thorough records of your notarial acts, including details of the identification used and any discrepancies encountered during the process.

It may apply to general legal documents. If you have the loan document for signing and the name is misspelled and different as ID card. Don’t cross out. Call the issuer of document to check If it is allow to cross out the name for correction.

If you have any doubts or encounter unusual circumstances during the notarization process, consider consulting the New York Department of State or seeking advice from legal professionals to ensure that you are following proper procedures and upholding the integrity of the notarial act.
